Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website located at consciousmovementlab.com ("Site") and all related content, memberships, and services (collectively, "Services") offered by Anicca Creative LLC, a Minnesota limited liability company doing business as Conscious Movement Lab ("Conscious Movement Lab," "we," "us," or "our"). By accessing the Site or purchasing a membership, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.


  1. DEFINITIONS

"Services" means all content, video libraries, membership programs, educational materials, movement instruction, and related digital products made available through the Site.

"Member" or "you" means any individual who creates an account and purchases a membership or other access to the Services.

"Content" means all video recordings, written materials, audio files, images, graphics, course materials, and any other media made available through the Services.

"Membership" means a paid subscription granting recurring access to designated Content as described on the Site at the time of purchase.

"Stripe" means Stripe, Inc., the third-party payment processor used to handle all payment card transactions.


  1. ELIGIBILITY

You must be at least 18 years of age to use the Services or purchase a Membership. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are accessing the Services on behalf of another person or entity, you represent that you have the authority to bind that person or entity to these Terms.

Residents of all U.S. states and most international jurisdictions are welcome to purchase Memberships. You are responsible for ensuring that your use of the Services complies with all laws applicable in your jurisdiction.


  1. SCOPE OF SERVICES

Conscious Movement Lab provides pre-recorded, on-demand digital movement education content, including fascial maneuver instruction, breathwork, yoga-informed movement, and related somatic practices. All Content is delivered exclusively through the Site via video streaming. No live or real-time classes are offered.

We reserve the right to modify, update, discontinue, or replace any Content at any time without notice, provided that active Members retain access to the tier of Content included in their purchased Membership for the duration of their billing period. We do not guarantee that any specific video, series, or module will remain available indefinitely.


  1. ACCOUNT CREATION AND SECURITY

To access the Services, you must create an account by providing a valid email address and creating a password. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You may not share your account credentials with any other person. Access purchased for one individual is for that individual's personal, non-commercial use only.

If you believe your account has been accessed without your authorization, you must notify us immediately at the contact information provided in Section 15. We are not liable for any loss or damage resulting from unauthorized account access caused by your failure to safeguard your credentials.


  1. MEMBERSHIPS AND PAYMENT TERMS

5.1 Membership Tiers

Membership options, including available tiers and current pricing, are described on the Site at the time of purchase. Pricing is subject to change. Any pricing changes will apply to new billing cycles following notice to you.

5.2 Billing and Recurring Charges

Memberships are billed on a recurring basis, either monthly or annually depending on the plan selected. By purchasing a Membership, you authorize Anicca Creative LLC, through Stripe, to charge your payment method automatically at the applicable rate on each billing cycle renewal date until you cancel.

All payment processing is handled by Stripe. Your payment card information is transmitted directly to and stored by Stripe. Conscious Movement Lab does not store, process, or have access to your full payment card details. Your use of Stripe's services is subject to Stripe's own terms and privacy policy, available at stripe.com.

5.3 Failed Payments

If a payment fails, we reserve the right to suspend or terminate your access to the Services until payment is successfully collected. We may attempt to recharge your payment method one or more times following an initial failed charge.

5.4 Cancellation

You may cancel your Membership at any time through your account settings or by contacting us. Cancellation takes effect at the end of your current billing period. You will retain access to the Services through the end of the paid period. Cancellation does not entitle you to a refund for any portion of a billing period already charged.

5.5 No Refund Policy

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS ON MEMBERSHIPS OR ANY OTHER PURCHASES, INCLUDING CASES OF PARTIAL USE, DISSATISFACTION, CANCELLATION BEFORE THE END OF A BILLING PERIOD, OR FAILURE TO USE THE SERVICES. By completing a purchase, you expressly acknowledge and agree to this no-refund policy.

The only exception is where a refund is required by applicable law that cannot be contractually waived. If you believe you are entitled to a refund under applicable law, contact us at the information in Section 15.

⚠️ LEGAL REVIEW RECOMMENDED: Certain U.S. states (notably California and Washington) and international jurisdictions (EU/UK consumer protection law) impose statutory cancellation or cooling-off rights that may override a no-refund policy for digital services. If you have a meaningful number of customers in those regions, a brief statutory carve-out or jurisdiction-specific addendum is advisable.

5.6 Taxes

Membership prices shown on the Site do not include applicable sales tax, VAT, GST, or similar taxes. You are responsible for any taxes imposed on your purchase by your applicable taxing authority. Where required by law, Conscious Movement Lab or Stripe may collect and remit applicable taxes on your behalf.

⚠️ LEGAL REVIEW RECOMMENDED: Sales tax obligations on digital services vary significantly by U.S. state and internationally. Minnesota and several other states have enacted digital services sales tax rules. Consult a tax advisor regarding your collection and remittance obligations, particularly as your customer base grows internationally.


  1. HEALTH, WELLNESS, AND MEDICAL DISCLAIMER

6.1 Educational Purposes Only

The Content provided through the Services is for educational and informational purposes only. It is not intended to constitute or replace medical advice, diagnosis, treatment, rehabilitation, physical therapy, or any other form of professional healthcare. Fascial maneuver instruction, somatic movement education, breathwork, and related content are movement education, not medical or therapeutic services.

6.2 Consult a Qualified Professional

Before beginning any new movement, exercise, or body-based practice — including any practice described or demonstrated in the Content — you should consult a qualified physician, physical therapist, or other licensed healthcare provider, particularly if you have any pre-existing injury, chronic pain condition, cardiovascular condition, respiratory condition, pregnancy, post-surgical recovery, neurological condition, or any other health concern.

6.3 Assumption of Risk

Movement and physical practice carry inherent risk of injury. By using the Services, you acknowledge that participation in movement-based activities is voluntary and that you assume full responsibility for any injury, harm, or adverse outcome that may result from your use of the Content. You agree to work within your own limits and to discontinue any practice that causes pain, dizziness, shortness of breath, or discomfort and seek appropriate care.

6.4 No Practitioner-Client Relationship

Your use of the Services does not create a practitioner-client relationship, therapist-client relationship, personal training relationship, or any other professional healthcare relationship between you and Conscious Movement Lab or Ashley, its founder. The Content is general educational material and is not tailored to your individual health circumstances.

6.5 Fascial Maneuvers Methodology

The fascial maneuvers methodology taught in certain Content originates with Human Garage. Conscious Movement Lab presents this methodology as a licensed practitioner and educational curator, not as the originator or developer of the methodology. Conscious Movement Lab makes no representations regarding outcomes and does not guarantee any specific physical result from use of the Content.

⚠️ LEGAL REVIEW RECOMMENDED: If you ever expand to offering personalized assessments, one-on-one sessions, or any service that could be characterized as individualized instruction or therapeutic guidance (even informally), additional liability exposure arises. The disclaimer as written is appropriate for a pre-recorded library with no personalized component. Revisit this section if your offering expands.


  1. INTELLECTUAL PROPERTY

7.1 Ownership of Content

All Content made available through the Services, including but not limited to video recordings, written materials, course outlines, graphics, branding, logos, and the overall structure and compilation of the Services, is owned by Anicca Creative LLC or is used under license, and is protected by applicable U.S. and international copyright, trademark, and intellectual property laws.

7.2 Limited License to Members

Subject to your compliance with these Terms and payment of applicable fees, Conscious Movement Lab grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable license to access and view the Content through the Site for your own personal, non-commercial use only. This license does not include the right to download, copy, reproduce, redistribute, publicly display, record, broadcast, transmit, sell, create derivative works from, or otherwise exploit any Content except as expressly permitted in these Terms.

7.3 Prohibited Uses of Content

You may not, directly or indirectly:

  • Download, screen record, or capture any video Content through any means

  • Share, redistribute, or re-upload Content to any platform or medium

  • Use Content for commercial purposes, including in any class, workshop, course, or business offering you deliver to third parties

  • Remove or alter any copyright, trademark, or proprietary rights notices contained in the Content

  • Use automated tools, bots, scrapers, or similar means to access or collect Content

7.4 Feedback

If you submit feedback, suggestions, or ideas about the Services to us, you grant Conscious Movement Lab a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and incorporate that feedback into the Services without any obligation to compensate you.


  1. USER OBLIGATIONS AND PROHIBITED CONDUCT

By using the Services, you agree that you will not:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation

  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

  • Attempt to gain unauthorized access to any portion of the Site, other user accounts, or any systems connected to the Site

  • Interfere with or disrupt the integrity or performance of the Site or Services

  • Use the Services in any manner that could damage, disable, overburden, or impair the Site

  • Attempt to decompile, reverse engineer, or otherwise access the source code of the Site

  • Use the Services to transmit any unsolicited commercial communications

  • Circumvent any technological measure implemented by us to protect the Content or control access to the Services


  1. PRIVACY AND DATA HANDLING

9.1 Information We Collect

We collect limited personal information necessary to provide the Services, including your name, email address, and billing-related information (such as billing address) when you create an account or make a purchase. We do not collect or store payment card numbers, CVV codes, or bank account information — all payment data is handled directly by Stripe.

9.2 How We Use Your Information

We use the information we collect to create and manage your account, process your membership and communicate with you about billing, send you service-related communications including receipts, updates, and important notices, and improve the Services.

9.3 Sharing of Information

We do not sell your personal information. We share your information only with Stripe for payment processing, with service providers who assist us in operating the Site (such as our hosting and email providers), and as required by law or to protect our legal rights.

9.4 Data Retention

We retain your account information for as long as your account is active and for a reasonable period thereafter for legal and business purposes. You may request deletion of your account data by contacting us at the information in Section 15.

9.5 International Users

The Site is operated from the United States. If you are accessing the Services from outside the United States, your information will be transferred to and processed in the United States. By using the Services, you consent to this transfer.

⚠️ LEGAL REVIEW RECOMMENDED: If you have a meaningful number of customers in the European Union, United Kingdom, or California, a standalone Privacy Policy that complies with GDPR, UK GDPR, and/or the California Consumer Privacy Act (CCPA) is strongly advisable. The privacy section above is a summary appropriate for low-data-collection businesses, but EU/UK and California residents have specific statutory rights that a full Privacy Policy should address.

9.6 Cookies

The Site may use cookies and similar tracking technologies to maintain session state and improve Site functionality. By using the Site, you consent to the use of cookies as described in any cookie notice displayed on the Site.


  1. THIRD-PARTY SERVICES AND LINKS

The Site may contain links to third-party websites or services, including Stripe and video hosting platforms. These links are provided for convenience only. Conscious Movement Lab has no control over and is not responsible for the content, privacy practices, or terms of any third-party site or service. Your use of any third-party service is governed by that third party's own terms and policies.


  1. DISCLAIMERS OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CONSCIOUS MOVEMENT LAB EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY CONTENT WILL PRODUCE ANY PARTICULAR PHYSICAL RESULT OR OUTCOME. RESULTS FROM MOVEMENT PRACTICE VARY BY INDIVIDUAL AND ARE NOT GUARANTEED.


  1. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANICCA CREATIVE LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES OR CONTENT, REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO CONSCIOUS MOVEMENT LAB IN THE TWELVE MONTHS IMMEDIATELY PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.


  1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Anicca Creative LLC and its members, managers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, your violation of any third-party right, or any injury or harm caused by your decision to engage in movement practices described in the Content.


  1. ACCOUNT TERMINATION

14.1 Termination by You

You may cancel your Membership at any time as described in Section 5.4. Cancellation terminates your Membership but does not delete your account. To request full account deletion, contact us at the information provided in Section 15.

14.2 Termination by Conscious Movement Lab

We reserve the right to suspend or terminate your account and access to the Services at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our sole discretion. In the event we terminate your account for reasons other than a material breach of these Terms, we will provide a pro-rated refund of unused Membership fees for the current billing period as our sole obligation to you. No refund will be issued for termination resulting from a breach of these Terms.

14.3 Effect of Termination

Upon termination for any reason, your license to access the Content immediately terminates and you must cease all use of the Services. Sections 7, 11, 12, 13, and 14 survive termination.


  1. DISPUTE RESOLUTION AND GOVERNING LAW

15.1 Governing Law

These Terms and any dispute arising out of or related to the Services are governed by the laws of the State of Minnesota, without regard to its conflict of law principles.

15.2 Informal Resolution

Before initiating any formal dispute process, you agree to contact us at ashley@consciousmovementlab.com and provide a written description of your dispute, giving us 30 days to attempt to resolve it informally.

15.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as set forth below. The arbitration will be conducted in English. The arbitrator's decision will be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU AND CONSCIOUS MOVEMENT LAB EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, OR REPRESENTATIVE PROCEEDING.

If the AAA Consumer Arbitration Rules are unavailable or inapplicable, arbitration shall be conducted under the AAA Commercial Arbitration Rules.

15.4 Small Claims Exception

Notwithstanding Section 15.3, either party may bring an individual claim in small claims court in Hennepin County, Minnesota, provided the claim qualifies for small claims court under applicable rules.

15.5 Injunctive Relief

Nothing in this Section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm, including to protect intellectual property rights.

⚠️ LEGAL REVIEW RECOMMENDED: Binding arbitration clauses and class action waivers are subject to ongoing legal challenge and have been invalidated or limited in certain jurisdictions, including under EU consumer protection law. If a significant portion of your customer base is in the EU or UK, arbitration clauses may not be enforceable against those customers. A Minnesota attorney can advise on current enforceability and whether a jurisdiction-specific carve-out is appropriate.


  1. CHANGES TO THESE TERMS

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where feasible, provide notice via email or a notice on the Site. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must cancel your Membership and discontinue use of the Services.


  1. MISCELLANEOUS

17.1 Entire Agreement

These Terms, together with any policies referenced herein, constitute the entire agreement between you and Anicca Creative LLC with respect to the Services and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions will continue in full force and effect.

17.3 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.

17.5 Force Majeure

Conscious Movement Lab is not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including acts of God, internet outages, third-party service failures, or government actions.
